Patently Appealing.

Exploring the pipeline at the Federal Circuit.

 

 

Welcome to the temporary (?) home of the Patently Appealing wiki.  The goal of this and the companion site (patentlit.typepad.com) is to identify and summarize patent-related appeals to the Federal Circuit early int he appeals process.  There are several great sites that discuss Federal Circuit decisions and opinions, but we thought it might be nice to know about the cases that the judges are about to hear and decide.  I mean, wouldn't it be useful to know that the Federal Circuit was currently considering a case on the same issue that you are facing at the District Court?

 

The basic format is that every Federal Circuit matter that looks to deal with an appeal of patent litigation (from the ITC or district court) will have its own page, with docket, lower court information, etc.  At some point we hope to include a brief description of the legal issues and arguments at issue on appeal--but, because the Federal Circuit's website does not presently allow access to or downloads of briefs, this information may take time to develop--and will require the help of counsel and good readers.

 

To find a case page, you can run a search via the box in the upper right corner, or click below on "Show all pages".

 

The sites are works in process, so please pardon the dust and changing formats etc. while we get organized here.  At the moment, only registered user (me) can edit pages or add content, but hopefully this will give way to an open wiki.
